MARLA J. MOSS, ESQ.  PROFESSIONAL MEDIATOR

Marla Moss has been a regionally recognized workplace mediator for ten  years. Her background includes over 30 years of experience as an attorney resolving business disputes.

She is often chosen by attorneys, business owners and claims professionals to mediate high exposure employment disputes- sexual harassment/hostile work environment, race/gender/disability discrimination, whistleblower retaliation and wage & hour matters.

On the business side, she handles complex commercial litigation, including fraudulent real estate transactions, environmental issues in property transfers & professional liability disputes.

In addition to private mediations, she acts as a court appointed mediator for the civil roster in the New Jersey Superior Court. Ms. Moss received her training at the Harvard Law School Program on Negotiation. She is a Past Chair of the Dispute Resolution Section of the New Jersey Bar Association “NJSBA” and has served in a leadership role in the mediation community for many years.

Her litigation background includes serving for 8 years as General Counsel to a group of closely held specialty chemical companies. Ms. Moss has also handled cases for Plaintiffs in business disputes, discrimination matters and whistleblower retaliation lawsuits. Her broad experience on both sides of the aisle allows for a more comprehensive view in her role as a neutral.

Appointed by Chief Justice Rabner to the New Jersey Supreme Court Complementary Dispute Resolution Committee in 2016. Appointed by the Chief Justice of the US Bankruptcy Court to the first Mediation Roster in 2014 along with other prominent mediators who were selected after a rigorous evaluation process. Elected Officer, Director and Chair of the Dispute Resolution Section of the NJSBA 2013-2018. Past Chair of the Employment Mediation Section of the New Jersey Professional Mediators Association 2011-2013. Member, Justice Marie Garibaldi ADR Inn of Court 2010-2017. Past Member, American Bar Association’s Dispute Resolution Section.  Member, Labor & Employment Section of NJSBA. Trustee of Women in Profession Section, NJSBA 2013-2018. Appointed by NJSBA President to serve on the Business & Commercial Litigation Committee of NJSBA 2014-2016.

FREQUENT SPEAKER ON MEDIATION TECHNIQUES:

Ms. Moss is often asked to speak on panels about the benefits of mediation, which are interactive discussions with attorney advocates. During mediation sessions she coaches litigants on active listening, expressing empathy and encourages the parties to brainstorm options. She uses her knowledge and experience to empower counsels as a neutral to exchange information, evaluate the strength and weaknesses of their cases and create the best possible resolution for their clients under the unique facts and circumstances presented. As a Professional Mediator she is able to skillfully manage angry and difficult negotiators. She uses her conflict resolution skills and humor to diffuse emotions and create an atmosphere that allows fair and balanced negotiations towards settlement.

Choosing A Mediator

Mediation is a cost effective alternative to litigation and arbitration where the disputants, together with their attorneys negotiate a resolution. The mediator is a neutral party.

When choosing a mediator, it’s important to do your due diligence. Interview your mediator to make sure you like her style. Retired judges are presumed to have the skill set of a mediator and some do, but before you make a decision that affects your client’s personal welfare or business bottom line, make sure that your mediator has a background in conflict resolution and excellent interpersonal skills. Your mediator should have substantive experience in the subject matter of your dispute, so check references. Pick a mediator who will empower you and your client to get the best results for your unique circumstances.

Studies show that disputants who negotiate a settlement in mediation are more satisfied than litigants who go to trial because the mediation process is intended to encourage, not coerce parties into resolution. Mediation is a confidential process. The mediator will use many tools to determine the needs of the parties and to bring the parties closer together, including caucusing in private sessions; facilitating “active listening” by each side; pushing for creative “out of the box” solutions; and providing a mediator’s recommendation when requested.
